China will adopt a system of hearing IP cases opening to the public
May 8, 2007On April 4, 2007, the head of work team of the State Intellectual Property said that, in order to increase the transparency of the judicial protection of IP rights, China will adopt a system of hearing IP cases opening to public, inviting members of the People’s Congress, members of the Political Consultation Committee, representatives of associations of industries and the relevant authorities, as well as representatives coming from foreign governments and international organizations in China.
A person in charge of the IP Division of the Supreme People’s Court said that it is the first time that we put the invitation of foreigners to audit IP trials into system.
There is an analysis that the reason why there are IP infringement cases popping up in China would be that a penalty is always replaced by fine, which is the commonly existing phenomenon in China, and leading to this fact that to crack down on the infringement in judicial way is not strong enough and that criminals will escape from the legal punishment.
It is said that to fulfill the system of hearing IP cases opening to the public, some of the most influential IP infringement cases will be chosen and the important information from trials will be published in news media.
