China’s Action Plan on IPR Protection 2007 has been published
May 8, 2007To expatiate on the intellectual property protection measures in a thorough, systematic and specific way, and guide the national IP works will, the National Intellectual Property Protection Working Group Office, in conjunction with other relevant government authorities, formulate “China’s Action Plan on Intellectual Protection 2007” (hereinafter referred to as the “Action Plan”), which covers ten areas and two hundred and twenty six specific measures.
In line with the Action Plan, the relevant authorities will draft, formulate and revise fourteen laws, regulations, rules and measures relating to trademark, copyright, patent and customs protection, and seven judicial interpretations as well.
Enforcement under the Action Plan will include fourteen dedicated campaigns such as the “Anti-pirates Every Day”, “Crackdown on piracy teaching materials and tutorial materials” and “Blue Sky Exhibitions”, and eleven regular enforcement initiatives.
The enforcement plan will also adopt eight measures to guarantee the creative capability and vitality. A high-efficiency standing mechanism will be built to assort with law enforcement, perfecting and regulating the function of the service center for reporting and complaining IPP violations in eight areas by adopting forty six specific measures.
Effort on publicity of the Action Plan will be intensified in eight varied forms and 84 specific measures, including among others holding large scales of propaganda, recording relevant programs and conducting press conference.
Training about intellectual property knowledge will be carried to government leaders, basic-level law enforcement personnel, enterprises, government institutions, government institutions, legal workers and students from middle schools and universities in thirty specific training measures, namely, compiling teaching materials, holding training classes and lectures and etc.
Twenty-six measures regarding dialogue, expedition, collaboration, intercommunication and training, will be taken to strengthen the international exchanges and cooperation in the field of intellectual property, including trademark, copyright and patent.
Nine measures as to compilation of enterprise listings, drafting of the “opinions on strengthening the protection of intellectual property by large state-owned enterprises” will be adopted to promote the awareness of protection of intellectual property by enterprises.
Eight measures, such as holding inter-communicating conference with foreign owned enterprises regularly, setting up hot lines and network service platforms for safeguarding rights, will be taken to provide service for right owners. Besides, it is in the plan that studies on twenty-three subjects of intellectual property will be carried out.
