Holley Beats Samsung in First Instance Judgment

A first instance judgment was issued on December 24 by the Hangzhou Intermediate People’s Court in the 20-month-old case of Zhejiang Holley Telecommunication Group Co. Ltd v. Shenzhen Samsung Kejian Mobile Technology Co,. Ltd. The court, held that Samsung infringed upon Holley’s patent “ZL02101734.4 CDMA/GSM double-model mobile communication method and equipment”, and ordered Samsung to stop producing and selling the product and pay restitution of 50 million Yuan to Holley.

In 2002, Holley applied to the State Intellectual Property Office for a patent on their double-model cell phone, and was granted it on May 25, 2005. At the end of 2006, Holley found that the hot-selling Samsung W579 violated its patent and lodged a suit in April 2007. In response, Samsung submitted on May 8, 2007 a request for declaration of invalidity to the Patent Reexamination Board of the Office, and the procedure came to a halt.

On December 14, 2007, the Office rejected Samsung’s request. On December 19, 2008, the first trial ruled on Holley’s behalf.
